This article applies the Kantian doctrine of respect for persons to the problem of sweatshops. We argue that multinational enterprises are properly regarded as responsible for the practices of their subcontractors and suppliers. We then argue that multinationalenterprises have the following duties in their off-shore manufacturing facilities: to ensure that local labor laws are followed; to refrain from coercion; to meet minimum safety standards; and to provide a living wage for employees. I provide an account of the cognitive attitude of trust that explains the role trust plays in the planning of rational agents. Many authors have dismissed choosing to trust as either impossible or irrational; however, this fails to account for the role of trust in practical reasoning. A can have therapeutic, coping, or corrective reasons to trust B to ${\phi}$ , even in the absence of evidence that B will ${\phi}$ . One can choose to engage in therapeutic trust to (...) inspire trustworthiness, coping trust to simplify one’s planning, or corrective trust to avoid doing a testimonial injustice. To accommodate such types of trust, without accepting doxastic voluntarism, requires an account of the cognitive attitude of trust broader than belief alone. I argue that trust involves taking the proposition that someone will do something as a premise in one’s practical reasoning, which can be a matter of believing or accepting the proposition. I defend this account against objections that it (i) provides insufficient rational constraints on trust, (ii) conflates trust and pretense of trust, and (iii) cannot account for the rationality of back-up planning. ABSTRACT:In a series of reports the United Nations Special Representative on the issue of Human Rights and Transnational Corporations has emphasized a tripartite framework regarding business and human rights that includes the state “duty to protect,” the TNC “responsibility to respect,” and “appropriate remedies” for human rights violations. This article examines the recent history of UN initiatives regarding business and human rights and places the tripartite framework in historical context. Three approaches to human rights are distinguished: moral, political, and legal. (...) It is argued that the tripartite framework’s grounding of the responsibility of TNCs to respect human rights is properly understood as moral and not merely as a political or legal duty. A moral account of the duty of TNCs to respect basic human rights is defended and contrasted with a merely strategic approach. The main conclusion of the article is that only a moral account of the basic human rights duties of TNCs provides a sufficiently deep justification of “the corporate responsibility to respect human rights” feature of the tripartite framework. Libertarian theories of the normative core of the corporation hold in common the view that is the responsibility of publicity held corporations to return profits to shareholders within the bounds of certain moral side-constraints. Side-constraints may be either weak (grounded in the rules of the game) or strong (grounded in rights). This essay considers libertarian arguments regarding the normative core of the corporation in the context of global capitalism and in the light of actual corporate behavior. First, it is argued (...) the weak side-constraints view is conceptually incoherent when applied in a global context. Second, it is argued that proponents of the libertarian strong side-constraints view lack an adequate theory of rights. Third, both the weak side-constraints view and the strong side-constraints view are shown to be unsatisfactory insofar as they fail to adequately address the coercive power of corporations. The main conclusion of this essay is that a viable libertarian theory of the corporation has yet to be articulated. (shrink)

It is sometimes said that there are two, competing versions of W. V. O. Quine’s unrelenting empiricism, perhaps divided according to temporal periods of his career. According to one, logic is exempt from, or lies outside the scope of, the attack on the analytic-synthetic distinction. This logic-friendly Quine holds that logical truths and, presumably, logical inferences are analytic in the traditional sense. Logical truths are knowable a priori, and, importantly, they are incorrigible, and so immune from revision. The other, radical (...) reading of Quine does not exempt logic from the attack on analyticity and a priority. Logical truths and inferences are themselves part of the web of belief, and the same global methodology applies to logic as to any other part of the web, such as theoretical chemistry or ordinary beliefs about ordinary objects. Everything, including logic, is up for grabs in our struggle for holistic confirmation. The purpose of this paper is to examine the law of non-contradiction, and the concomitant principle of ex falso quodlibet, from the perspective of the principles advocated by the radical Quine. I show that he has no compelling reason to accept either of these. To put it bluntly, neither the law of non-contradiction nor the rule of ex falso quodlibet is empirically confirmed, and these principles fare poorly on the various criteria for theory acceptance on the methodology of the radical Quine. So the radical Quine is led rather quickly and rather directly into something in the neighborhood of Graham Priest’s dialetheism. (shrink)

Reflecting on my years of experience as both a philosopher and a musician, I am increasingly intrigued by speculating if and how today’s aesthetic discourse might have taken a different direction if music been its central focus. Central to Aristotle's metaphysics and epistemology is the claim that ‘aitia’ – ‘cause’ – is “said in many ways”, i.e., multivocal. Though the importance of the four causes in Aristotle's system cannot be overstated, the nature of his pluralism about aitiai has not been addressed. It is not at all obvious how these modes of causation are related to one another, or why they all deserve a common term. Nor is it clear, in particular, whether the causes are related to (...) one another as species under a single genus, such that there is a univocal definition of ‘aitia’ which applies to all of them, or whether Aristotle means to assert that the four causes are homonyms. It is argued here that although there are strong reasons to group the four causes together, there are also powerful considerations on the side of homonymy. It is further argued that the four causes are more closely tied to the ontological theory of categories and predication than is often recognized. As a result, we can reconcile the competing demands of unity and plurality by taking one mode of causation, the formal cause, as basic, and accounting for the other modes with reference to it, in the manner of so-called pros hen homonyms. This article – which includes a complete translation of Mūlamadhyamakakārikā chapter 2 together with Candrakīrti’s commentary thereon – argues that notwithstanding the many different and often arcane interpretations that have been offered of Nāgārjuna’s arguments against motion, there is really just one straightforward kind of argument on offer in this vexed chapter. It is further argued that this basic argument can be understood as a philosophically interesting one if it is kept in mind that the argument essentially has to do (...) with whether a personal level of description will admit of an exhaustively impersonal explanation. There are, of course, many important differences between the deployment of cultural authority in the social context of second-century Christianity and that of twentieth-century academia. The editors of the Norton Anthology, for example, do not actively seek to suppress those voices which they exclude, nor are their principles for inclusion so narrowly defined as were the church fathers’. But the literary academy and its institutions developed from those of the Church and continue to wield a derivative, secular version of its (...) social and cultural authority. Since Matthew Arnold, the instutition of literature has been described in terms which liken its authority to that of religion, not only by outsiders—Woolf’s woman “divining the priest”—but by insiders who continue to employ the stances and language of religious authority; see, for instance, J. Hillis Miller’s credo in a recent issue of the ADE Bulletin: “I believe in the established canon of English and American literature and in the validity of the concept of privileged texts. I think it is more important to read Spenser, Shakespeare, or Milton than to read Borges in translation, or even, to say the truth, to read Virginia Woolf.”9 Such rhetoric suggests that the religious resonances in literary texts are not entirely figurative, a point brought out strikingly by revisionary religious figures in feminist texts. In her recent essay “ ‘The Blank Page’ and the Issues of Female Creativity,” Susan Gubar cites as some of the “many parables in an ongoing revisionary female theology” Florence Nightingale’s tentative prophecy that “the next Christ will perhaps be a female Christ,” H. D.’s blessed Lady carrying a “Bible of blank pages,” and Gertrude Stein’s celebration of The Mother of Us All.10 The revisionary female theology promoted in literary writing by women implicitly counters the patriarchal theology which is already inscribed in literature. The prophesied female Christ, blank Bible, and female Creator revise images familiar in the literary tradition, and, in contrast to earlier appropriations of religious imagery by Metaphysical, Pre-Raphaelite, and other poets, make visible the patriarchal preoccupations of literary “theology.” These voices, like the Gnostic voices recovered at Nag Hammadi, are only now being heard in chorus; and Pagels’ study of “the gnostic feminism” helps to illuminate some aspects of a cultural authority predicated on the suppression or domination of other voices. Sir Karl Popper is well known for explicating science in falsificationist terms, for which his degree of corroboration formalism, C(h,e,b), has become little more than a symbol. For example, de Queiroz and Poe in this issue argue that C(h,e,b) reduces to a single relative (conditional) probability, p(e,hb), the likelihood of evidence e, given both hypothesis h and background knowledge b, and in reaching that conclusion, without stating or expressing it, they render Popper a verificationist. The contradiction they impose is easily (...) explained--de Queiroz and Poe fail to take account of the fact that Popper derived C(h,e,b) from absolute (logical) probability and severity of test, S(e,h,b), where critical evidence, p(e,b), is fundamental. Thus, de Queiroz and Poe's conjecture that p(e,hb) = C(h,e,b) is refuted. Falsificationism, not verificationism, remains a fair description of the parsimony method of inference used in phylogenetic systematics, not withstanding de Queiroz and Poe's mistaken understanding that "statistical" probability justifies that method. Although de Queiroz and Poe assert that maximum likelihood has the power "to explain data", they do not successfully demonstrate how causal explanation is achieved or what it is that is being explained. This is not surprising, bearing in mind that what is assumed about character evolution in the accompanying likelihood model M cannot then be explained by the results of a maximum likelihood analysis. To paraphrase Freud, what do socialists really want? It is undoubtedly difficult to give a complete answer to this question that all socialists would be satisfied with, but there are some common elements that can hardly be denied. First and foremost among these is the elimination of capitalism; the elimination of capitalism would seem to require the elimination of capitalists. Why might that be desirable? Well, many reasons might be offered, but one is suggested by the very nature of capitalism.

Both advocates and opponents of lesbian, gay, and bisexual rights make reference to whether and how sexual orientations are embodied, namely whether one's sexual orientation is innate, unchangeable, or a "natural fact". In particular, in the United States, discussion centers on whether LGB people are "born that way" or "choose" to be gay. In litigation about LGB rights, this discussion connects to the so-called immutability factor in the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution and in (...) similar clauses in state constitutions. My presentation surveys the surrounding conceptual and the legal issues and focuses on how they play out in the context of recent court cases related to marriage for same-sex couples. I argue that in legal as well as political and social contexts, it is a better strategy to focus on justice, equality and fairness and to avoid biological, psychological, and other scientific issues about how sexual orientations are embodied. From church-sponsored AIDS prevention campaigns in Africa to Muslim charity efforts in flood-stricken Pakistan to Hindu charities in India, religious groups have altered the character of the global humanitarian movement. Moreover, even secular groups now gesture toward religious inspiration in their work. Clearly, the broad, inexorable march toward secularism predicted by so many Westerners has halted, which is especially intriguing with regard to humanitarianism. Not only was it a highly secularized movement just forty years ago, but its principles were based (...) on those we associate with " modernity: cosmopolitan one-worldism and material (as opposed to spiritual) progress. How and why did this happen, and what does it mean for humanitarianism writ large? That is the question that the eminent scholars Michael Barnett and Janice Stein pose in Sacred Aid, and for answers they have gathered chapters from leading scholars that focus on the relationship between secularism and religion in contemporary humanitarianism throughout the developing world. Collectively, the chapters in this volume comprise an original and authoritative account of religion has reshaped the global humanitarian movement in recent times. (shrink)

Effective Altruism is a movement and a philosophy that has reinvigorated the debate about the nature of beneficence. At base, it is the consistent application of microeconomic principles to beneficent action. The movement has exposed that many forms of giving do little good (or do active harm), but others do tremendous good. Questioning Beneficence uses Effective Altruism as a launchpad to ask hard questions about beneficence more generally. Must we be Effective Altruists, or is Effective Altruism and the ideas driving (...) the movement a mistake? How much should we give and-if anything-how should we give it? What are the respective roles of different kinds of institutions? Is charity anti-democratic and do billionaire philanthropists have too much power? Is Effective Altruism just utilitarianism in disguise? Questioning Beneficence is written by four philosophers, each with distinct points of view. It introduces a new standard for debating ideas in philosophy as each author poses and answers three questions and each of his three co-authors responds to those questions in turn. Finally, the first author replies to his co-authors' responses. Throughout the book, there is a spirit of curiosity, intellectual risk taking, and truth-seeking, rather than point-scoring and one-upsmanship. Questioning Beneficence demonstrates what open-minded, real dialogue over an important issue can be at its very best. (shrink)

From its dissonant musics to its surrealist spectacles (the urinal is a violin!), Modernist art often seems to give more frustration than pleasure to its audience. In Untwisting the Serpent, Daniel Albright shows that this perception arises partly because we usually consider each art form in isolation, even though many of the most important artistic experiments of the Modernists were collaborations involving several media--Igor Stravinsky's The Rite of Spring is a ballet, Gertrude Stein's Four Saints in Three Acts is (...) an opera, and Pablo Picasso turned his cubist paintings into costumes for Parade. Focusing on collaborations with a musical component, Albright views these works as either figures of dissonance that try to retain the distinctness of their various media (e.g. Guillaume Apollinaire's Les Mamelles de Tiresias ) or figures of consonance that try to lose themselves in some total effect (e.g. Arnold Schoenberg's Erwartung ). In so doing he offers a fresh picture of Modernism, and provides a compelling model for the analysis of all artistic collaborations. Untwisting the Serpent is the recipient of the 2001 Susanne M. Glasscock Humanities Book Prize for Interdisciplinary Scholarship of the Center for Humanities Research at Texas A&M University. (shrink)
